After starring in the film, Isn’t It Romantic, in early 2019, actor Liam Hemsworth sought to promote the movie by posting a production photo to his personal Instagram page. However, the actor did not seek or attain approval to use the copyrighted image, according to the Inquisitr.
The photo, taken by Janet Mayer, was originally posted to Hemsworth’s Instagram in 2018, using hashtags linked to the film’s promotional page. Hemsworth then posted the image two more times this year in near conjunction with the Teen Choice Awards.
The suit, brought by Splash News and Picture Agency, alleges that the actor used the image this past summer to garner votes for the Teen Choice Awards. The suit goes on to allege that the use of the image was part of a marketing scheme for the film.
If the suit succeeds, Hemsworth could owe up to $150,000 for the copyrighted image. Although many celebrities’ social media accounts a run by other people, it is still the responsibility of the social media manager and the celebrity to ensure that what is being posted to the account is legal.
