The Kardashian’s just will not stop trending, this time it’s Kim Kardashian making headlines for being awarded 2.7 million dollars after winning her trademark infringement lawsuit against clothing brand Missguided USA who failed to respond to the suit, therefore leaving the judge no other option but to grant the default judgement in Kim’s favor.
Kim filed suit in February 2019 after posting a picture on Instagram of her wearing a custom Yeezy dress that had yet to hit the market with the caption “… fast fashion brands please wait until I wear this in real life before you knock it off?” Within hours, Missguided posted their model wearing a replica of Kim’s dress along with the caption “The devil works hard but Missguided works harder,” leading to allegations that Kim was leaking partnership with the fashion brand and the photo was a part of a behind-the- scene deal, something she has since publicly denied.
Kim accused Missguided USA of making a habit out of using her name and likeness to sell and promote knockoff low-price copies of her own clothing. Therefore, stating that the fashion brand engages in trademark infringement and unfair competition. Kardashian asserted in her complaint, other companies, such as Missguided “have sought out ways to leverage her celebrity status and social media following without seeking her consent, turning her into an unwitting and unwilling spokesperson of their products.”
Not that Kim needs the extra coins, but the win could be viewed as a warning to other fashion brands who Kim claims constantly uses her name to promote knockoffs of her designs.
